Supplementary Protection Certificates (SPCs)

Patents related to medicinal products or plant protection products may, under certain circumstances, benefit from an extension of the maximum patent protection of 20 years. A Supplementary Protection Certificate (SPC) should be requested for this purpose. They compensate for the often lengthy authorisation procedures linked to the marketing of a medicine or plant protection product.

The maximum supplementary protection is five years. For medicinal products tested for use by children, an additional six months may be obtained. A Supplementary Protection Certificate may be applied for as soon as the medicinal product or plant protection product has been authorised.
