Plant breeders’ rights

New plant varieties can be protected by the so-called breeders’ rights system. This can be done both nationally and internationally, for example through Community plant breeders’ rights.

A breeders’ certificate is only granted for a new variety which is sufficiently uniform and stable.

  • New: A variety is new if it clearly distinguishes itself from any other variety by one or more relevant features.

  • Homogenous: The variety must be sufficiently homogeneous, considering the distinctive features inherent to its sexual or asexual propagation.

  • Stable: The new variety must continue to conform to the description given in the breeder's certificate.
